As labour and capital markets transcend domestic borders, the objectives of employment and labour law can no longer be confined solely to actions within the nation state. At the same time, challenges arising from the gig economy, the use of technology and global production chains call into question traditional forms of regulation.
The purpose of this subject is two-fold. First, to identify the diverse components of international employment and labour law, the institutions and the methods for advancing social protection and fundamental rights to workers worldwide. This enquiry spans beyond traditional instruments (such as Conventions of the International Labour Organization) that are associated with labour law, but also more recent approaches involving trade law and corporate social responsibility.
The second goal is to assess how international developments affect domestic labour law with a particular focus on five key jurisdictions: the European Union, the United States, Japan, China and India.
